STATEMENT OF THE CIVIL SOCIETY REPRESENTATIVES

STATEMENT OF THE CIVIL SOCIETY REPRESENTATIVES WITH RESPECT TO THE FULFILLMENT OF THE REQUIREMENTS OF PACE RESOLUTION 1609 OF

17 APRIL 2008

Having examined the domestic political situation and the measures taken by Armenian authorities to fulfill the requirements stipulated by the Parliamentary Assembly of the Council of Europe’s (PACE) Resolution 1609, we, the undersigned participants in the summary discussion on PACE Resolution 1609 of 17 April 2008, hereby affirm that:

· The unlawful actions that accompanied the 2008 presidential elections have brought forth distrust toward the electoral process and the authority formed in its result;

· The curtailing of human rights and the violent actions, which began after the elections and took on a new character and impetus following the March 1 tragedy, have further deepened the citizen discontent; and,

· Armenian authorities continue to disseminate inaccurate information and issue apparent false statements to the international bodies with the aim of gaining their trust, but in the meantime they continue their unlawful and violent actions against the freedom of opinion at home.

We also register that even though the Armenian authorities are initiating certain steps toward the implementation of PACE Resolution 1609, and specifically the provisions set out in its twelfth section, in essence these steps cannot be considered a fulfillment of the requirements of this resolution because:

· In terms of the March 1 tragedy and the ensuing circumstances, no investigation has been launched to date and no one has faced responsibility for the ten casualties and the hundreds of injured. The authorities attempted to transform this matter, which the country’s Ombudsman had raised concerning the lawfulness of the actions taken by the competent bodies, into an allegation that the human rights defender had over exceeded his empowerment;

The task of carrying out an “independent, transparent, and reliable investigation” is assigned to the parliamentary commission comprising the majority of the ruling coalition members, who do not enjoy the people’s trust and have demonstrated their anti-democratic nature on numerous occasions;

· The absolute majority of those who were arrested for their political convictions have not been released. In some cases their jail sentence was commuted, but they still are charged with committing different crimes, and this in the case when false testimonies are at the basis of these charges while the preliminary investigations and court hearings are conducted with numerous infringements;

The political pursuit continues still, the people are taken under police custody without legal grounds, they are subjected to intimidation and dismissed from their jobs; and,

· On 12 June 2008, a mere superficial—cosmetic, if you will—changes were made in the Armenian law “On Holding Assemblies, Public Meetings, Marches, and Demonstrations.” And in result the citizens’ constitutionally protected right to hold pacific assemblies and without the presence of any arms is curtailed even now and the substance of the anti-democratic law, which was passed on March 17, has not changed to all intents and purposes. And in actual fact, the right of free assembly and holding protest marches is hindered by the discretionary, discriminatory, and obscure decisions taken by the authorities. In addition, the activities of NGOs still are impeded.

We state that the process of fulfilling the requirements set out in PACE Resolution 1609 carries an imitational nature in Armenia and this bespeaks the absence of a political will to implement democratic reforms in the country. We therefore declare that the activities carried out to honor the requirements of PACE Resolution 1609 are unsatisfactory.

MISSION D’ENQUETE

Is civil society taking shape in Armenia?

Armenian society, or some segment of it at least, is becoming more active and less apathetic to the situation in the country, which can be summarized simply as one where the people are disrespected and ignored on a daily basis by their leaders. This leads me to speculate as to whether the political crisis brought about by the presidential elections and the turmoil that followed, might have inadvertently sowed the seeds for a bona fide civil society to grow in the country.

Election Secrets Revealed

Crying foul over chicanery at Armenia's polls and the honeyed tones of European diplomacy.

by Marietta de Pourbaix-Lundin and Matyas Eorsi
Transitions Online.

[The Parliamentary Assembly of the Council of Europe has threatened to suspend Armenia’s voting rights in the body unless it makes considerable progress toward democratic and judicial reforms by PACE’s June session. PACE sent observers to witness Armenia’s presidential election in February. It declared the voting to be “mostly in line with the country’s international commitments, although further improvements are necessary to address remaining challenges.” John Prescott, a former British deputy prime minister who headed the delegation, said, “While we noted improvements in the framework for these elections, problems with its implementation, especially during the vote count, in some cases undermined the trust of the people.” Marietta de Pourbaix-Lundin, a parliamentarian from Sweden who was part of the Armenia mission, considered that an understatement. She delivered her speech during PACE’s 14 April session.]

I have been in this parliamentary assembly since January 2007 and I have observed elections in four countries: Turkey, Ukraine, Russia and Armenia. The elections I observed in Armenia were the worst I have seen so far. The opening of the polling stations and the proceedings on the day were not too bad, but the counting in the polling station that I chose to visit was a disaster. Everything that could go wrong did go wrong. The number of voters who had voted and who had been marked on the list of voters was not counted, unused ballot papers were not destroyed and the protocol in which the results were to be entered had already been signed by members of the election committee.

Pourbaix-Lundin The most serious incident involved the chairperson
of the local election committee reading out the wrong names when
the ballot papers were to be put into different piles for the nine
candidates. The chairperson was well aware of what she was doing. She
was taking votes from Levon Ter-Petrosian and allocating them to the
[then-] prime minister, Serzh Sarkisian. Election officials tried
to hide what they were doing by holding their hands over the ballot
papers or by placing them in the middle of the piles so that I could
not see them.

When the officials were supposed to sum up the votes for the
different candidates, 100 votes were missing. I know that I was
not supposed to say anything but I could not help mentioning what
I had seen, so the officials pretended to count the votes quickly
and then decided that those votes should go to Serzh Sarkisian,
the guy who won the election. All candidates were allowed to have
proxies to observe the elections and the counting, but the only
observers at the polling station I chose were three young men from
Serzh Sarkisian's party. These three young men created an unpleasant
and uneasy atmosphere in the room. My interpreter was very scared
and asked me not to say anything more but just to observe and take
notice. I noticed that all the election officials were well aware of
what they were doing and they felt uneasy when I stood behind them
watching the electoral fraud. But that did not prevent them from
continuing to do what they had probably already planned, namely to
ensure that the sitting prime minister got enough votes so that there
would be no need for a second round. If what I observed occurred in
just one-tenth of the polling stations, of course there would have
been an effect on the result. I reported everything that I saw and
returned to my hotel disillusioned, upset and tired. I could not sleep.

I am very critical of the fact that from a press conference the
following day you could have got the impression that the election had
been conducted in the most correct way and according to international
standards. Do we help the Armenian people by believing that? I do
not think so.

I also went to visit the parliament building. I tried to take a
photograph, but three policemen and guards rushed after me and said,
"No, no. You can't take a photo." I asked them in Russian, "Why?" and
they told me that the parliament was "secret." That summarizes very
well the current position in Armenia. If a stronghold of democracy,
which is what a parliament should be, is secret, there are no
opportunities for democracy, transparency, human rights or free and
fair elections.

[Three days later, during another session on the Armenian election,
Hungarian delegate Matyas Eorsi made the following remarks:]

One problem is that we often tolerate rigged elections. If you visit
the assembly's website, you will often see headlines in the "news"
section that say, "One step towards democracy"; we all know that
we are not telling the truth. There can be some improvements in the
election environment, but very often the elections in question are
rigged. If we want to be helpful to those countries, the least we
can do is speak up and tell the truth. Very often, when we discuss
our relationship with member countries where there are democratic or
election deficits, we reiterate the point that we have to reinforce our
consultation with the governments of those countries so that elections
can be conducted better, but if there are shortcomings in an election
or administrative problems, we can do a lot to improve those elections.

In a country where an election is rigged, or has involved fraud or
cheating, what the hell can we discuss with those governments? Can we
say, "Please do not do this?" Of course they are fully aware of what
they are doing. I do not think it is a matter of consultation. One
of the major problems in Armenia, aside from what happened on that
tragic day, is the general distrust of the democratic processes among
the population because of the rigged elections. At the end of the
day, those who lose the election cannot disprove the legitimacy of
the election because of the procedures, which they have become used
to. Of course it matters who wins an election, but it matters much
more that wider society should be able to trust and have confidence
in the constitution and the electoral processes.

The Alliance of Liberals and Democrats for Europe fully supports the
recommendations of the rapporteurs that call for dialogue. ... The
recommendations also call for the release of political prisoners,
but they put the point somewhat more nicely, and they call for the
removal of the amendments on the election law that resulted in the
rigged elections. We support that, but if we are honest to ourselves,
we all know that the preconditions will never be met. I do not think
that the political environment is such that the government could make
such a compromise.

Marietta de Pourbaix-Lundin is a Swedish member of the Parliamentary
Assembly of the Council of Europe. Matyas Eorsi is a Hungarian member
of PACE.

Gagik Tsarukyan to open world-class casino in Armenia

One of the richest Armenian businessman Gagik Tsarukyan’s Multi Group Company, in partnership with Russian Storm International has constructed the most impressive gaming facility in the region - the Shangri La Casino, which will officially open on April 16th, with the Grand Opening scheduled for May 2nd. There are also some unverified reports, that the Storm International have opened a special school in Armenia to prepare qualified staff for the casino business. This is a clear indication of plans to further expand the gaming industry and turn Armenia into a Caucasian Monte Carlo.

Natural gas prices

The price of natural gas for the population will sharply rise to 84,000 AMD per 1000 cubic meters, from the current price of 59,000 AMD per 1000 cubic meters.

In 2006, the price of gas rose to $ 110 US per 1000 cubic meters and at that point the Armenian government made a decision to subsidize the price of gas in the country by the amount of 188 million dollar equivalient AMD. In the prices set back in 2001, that meant, that the population would have to pay 59,000 AMD, instead of 84,000 AMD per 1000 cubic meters, and that the government would be subsidizing 25,000 AMD per 1000 cubic meters for the population. However, as Prime minister Tigran Sargsyan informed the public yesterday, the 188 million dollar worth subsidy has run out, and from May 1, new prices will come into effect.

There are however, some very big questions, which need to be addressed in ragards to the gas prices. The prices of gas are defined by the US dollars. The average exchange rate per 1 USD was 420 drams in 2006, and in April-May 2006, when, if I recall correctly, the deal was struck, the rate was 450 AMD. So that meant, that at that point, the price of 1000 cubic meters of gas was equal to 49500 AMD ($110 US), and the price was set for resale to the population was defined at 84000 AMD ($ 186). Today, as the US exchange rate has dropped to 309 AMD, the price of 1000 cubic meters of gas is in fact 33990 AMD ($110), and the price for population remains at 84000 AMD - which is $ 270 US. So the price of gas per 1000 cubic meters has in fact shot up $90! In today’s prices, $90 makes 27810 AMD, which is 2810 drams more, then the amount of subsidy (25,000), Armenian government says it was paying for the gas sold to the population. This means, that not only there is no reason for the gas price increase, but, that the claims made by the RA government, that the 188 million dollar subsidy has been spent is also ridiculous, because with the current exchange rates, the ArmRusGazArd have actually been saving the government subsidy money and making extra profits. In fact, the government needs to ask - why isn’t price for gas decreasing, instead of standing in front of public with most ridiculous explanations about the price rises. Needless to say, that this new price rise will soon be felt on the prices of all other consumer goods. Excellent start for the new Prime Minister!

APPEAL TO THE PARLIAMENTARY ASSEMBLY OF THE COUNCIL OF EUROPE

(April 17 plenary session)

We, the undersigned Armenian Non-Governmental Organizations, call upon the deputies of the Parliamentary Assembly of the Council of Europe to adopt a resolution that will contribute to the resolution of the gravest political crisis in the history of modern Armenia.

The current crisis began following the large-scale falsification of the 19 February, 2008 presidential election by Armenia’s current authoritarian regime. Electoral violations included the systematic beating and intimidation of proxies of the main opposition challenger, Levon Ter-Petrossian, the intervention, in coordination with the police, of criminal gangs in the electoral process, ballot-stuffing, vote-buying, multiple voting, flawed counting and tabulation processes, and refusals to register or consider the appeals of Ter-Petrossian’s team by electoral commissions at all levels.

Beginning on 20 February, several hundred thousands of people staged demonstrations, marches, and all-night vigils in an improvised tent camp in Freedom Square – the traditional venue for mass democratic protests since 1988 – to protest the most disgraceful election in the history of Armenian democracy. Eleven days of demonstrations ensued, praised by an official US statement for “effective crowd management” and their exclusively peaceful character.

On 1 March, however, the police, acting on the orders of the highest authorities and without warning, attacked and dispersed the demonstrators at 6:50 a.m., launching a police operation during which thousands of people were beaten all throughout the capital of Armenia, Yerevan, in order to prevent them from gathering. Later that morning, at 9:00, the police once again attacked tens of thousands of protesters who had spontaneously gathered near the French Embassy. Clashes ensued and seven civilians and one policeman died under yet unclear circumstances; there is strong evidence of excessive lethal force by government special forces.

The peaceful nature of the demonstrations and the inappropriately brutal response of the authorities give credibility to claims by the opposition that the disorder was provoked and the clashes planned in advance by the government, in order to declare a state of emergency before a ruling by the constitutional court would be issued on the opposition demand to recognize the election results as invalid and conduct new elections. The state of emergency, which allowed the regime to arrest more than one hundred political leaders and members of the Ter-Petrossian campaign, silence the independent press, and suspend the activities of political parties, deprived the opposition of the opportunity to make its case freely and under the scrutiny of a democratically functioning society. Intimidation of members of the constitutional court was also reported. The regime further restricted the freedom of assemblies through hastily enacting legislation, which allows the authorities to ban opposition rallies practically at will.

The response of the international community to the rigged 19 February elections, the 1 March brutal crackdown on peaceful demonstrations, and the unlawful imposition of the state of emergency, as well as modifications in the law on assemblies, which effectively eliminated right of free assembly in Armenia, has been shocking. The unprecedented consolidation of civil society and more than 25 parties in a nation-wide pro-democracy movement was essentially ignored by the democratic community of Europe. By continuing business as usual with the Armenian authorities, democratic European countries effectively sided with a brutal oppressive regime, which lost even the remnants of any popular support after the bloody events 1 March.

In order to restore the constitutional order in the country, prevent the authorities from oppressing the democratic movement with impunity, and restore political stability in the country and the legitimacy of the presidency, we urge the deputies of the PACE to adopt a resolution, which

  • Does not recognize the outcome of the 19 February, 2008 presidential election,
  • Demands the conduct of a new, free and fair, presidential election,
  • Calls for an independent international investigation of 1 March events,
  • Demands the immediate release of all political prisoners,
  • Demands the restoration of freedom of speech, media, and assembly.
